THEME, TOPIC, SPEAKER ‘CONDITIONS OF CONTRACT’ Some Critical Provisions in Problem Solving in Construction Contracts’ Aziz N Karim BSc(Eng), BSc(QS), FRICS, MCIArb, Senior Contracts
Engineer, Abu Dhabi Gas Industries Ltd (GASCO) (02-603 709)(681-4577)(anka@emirates.net.ae) It is now thirteen
years since PCE UAE was established based on the result of a survey of wishes
of over 600 engineers in UAE. The
Chairmen of the then UAE Branches of the ICE and IMechE signed a petition
sent to the respective Councils in UK to disband the branches and give a lead to form one body - PCE
UAE – better able to welcome and serve all members of the then 40 EC licensed
Institutions should they have members in the country. The Councils of these two key Institutions
confirmed acceptance of the agreement.
Branch Chairmen signing at the time were Er David J Spearing CEng,
FICE Partner in Godfrey, Heath & Spearing, still a member of the PCE UAE
Committee, and ErEurIng Harry A Carrier CEng, FIMechE then General Manager of GASCO – an
Operating Company within the Abu Dhabi National Oil Company (ADNOC) Group. Then and now ADNOC Group employs many
multi-discipline national and expatriate engineers and other professionals
welcomed by PCE UAE. It is therefore
a pleasure to welcome as speaker for June Aziz N Karim an executive with
GASCO Commercial Division. TOPIC OUTLINE The lecture will address the contract definition and
existence, under different legal jurisdictions, with reference to UAE law,
the classification of contracts, and provisions of particular importance that
face professional practitioners in their daily work such as the law of
contact, the role of the engineer, variations, liquidated damages, surviving
clauses, ADR, etc. The topic will be
presented to encourage interactive discussion. Reference will be made to Conditions of Contract used in the
Oil, Gas and Petrochemical Industries and to FIDIC and ECC Suite used for
London Olympics contracts and some contracts in the UAE. SPEAKER PROFILE Aziz Nouri Karim is Iraqi, Married and able
to deal in English, Arabic, Kurdish languages. He is a graduate Civil Engineer from the University of Baghdad
and Graduate in Quantity Surveying from the University of Greenwich, UK and
Fellow Royal Institute of Chartered Surveyors and Member Chartered Institute
of Arbitrators, UK He is an
Arbitrator and registrant with Arab bodies in Abu Dhabi, Dubai, Ajman, Jordan
& Iraq Aziz started work as an engineer in Baghdad prior to studies and
work with QS companies in UK before returning to Iraq in 1978 where he became
head of the Contracts Department and later Design and Studies Division of the
State Organisation for Building.
Between 1987 and 1994 he undertook posts as Project Manager on major
developments, becoming Head of Projects Department of the State Commission
for Supervision and Follow-up at The Ministry of Housing & Construction
with a staff of 60 engineers before moving to Jordan in 1994 to join a major
Project Management and Quantity Surveying practice prior to joining GASCO in
1997 He has recently published a book ‘Contracting Strategies and
Management’ announced in ‘Construction week’ 2009 04 04-10. Experience has been summarised – the speaker will elaborate appropriate
to audience |
